Welcome to BREATH Hideaways Tasmania. These Terms and Conditions ("Terms") govern your use of our website at www.breathtasmania.com and any booking made with us.

By accessing our website or making a booking, you accept these Terms in full. If you do not agree with any part of these Terms, please do not use our website or make a booking.

In these Terms, "Client", "You", and "Your" refer to the person accessing the website or making a booking. "The Company", "We", "Us", and "Our" refer to BREATH Hideaways Tasmania.

1. Bookings

• A booking is confirmed once payment (or the required deposit) has been received and you have received a confirmation from us.
• You must be at least 18 years old to make a booking.
• You are responsible for ensuring all details provided at the time of booking (dates, guest numbers, contact details) are accurate.
• The number of guests staying must not exceed the maximum occupancy stated for the property.

2. Payment

• Full payment (or a deposit, as specified at the time of booking) is required to confirm your reservation.
• Payments are processed securely through our third-party payment provider. We do not store your full card details.
• Any outstanding balance is due as specified in your booking confirmation.

3. Cancellations and Changes

We understand that plans can shift. Each stay is carefully prepared in advance, so our cancellation policy is designed to balance flexibility with the time and care that goes into every arrival.

• More than 30 days before arrival — Choose a full refund or a change of dates, subject to availability.
• 30 to 14 days before arrival — Choose either a 50% refund or a change of dates, subject to availability.
• 14 to 7 days before arrival — Stays are no longer refundable at this stage. We're happy to support a change of dates where possible, with one reschedule available.
• Less than 7 days before arrival — Stays are final and cannot be refunded or changed.

If something unexpected comes up, please reach out — where we can, we'll always try to help.

4. Check-In and Check-Out

• Check-in time: 3:00pm
• Check-out time: 10:00am, midday on Sundays

Early check-in or late check-out may be available on request, subject to availability, and may incur an additional fee.

5. Guest Conduct and Property Use

• The property must be treated with care and used only for lawful, residential purposes.
• Guests are responsible for any damage caused to the property or its contents during their stay, beyond normal wear and tear.
• We reserve the right to charge the card on file, or invoice separately, for the reasonable cost of repairing or replacing damaged items.
• Excessive noise, disruptive behaviour, or breach of house rules provided at check-in may result in the stay being terminated without refund.
• Smoking, illegal substances, and pets are not permitted unless expressly agreed with us in advance.

6. Our Right to Cancel

We reserve the right to cancel a booking in exceptional circumstances (e.g. property damage, safety issues, or unforeseen unavailability). Where we cancel a confirmed booking through no fault of yours, we will offer a full refund or an alternative date, at your choice.

7. Force Majeure

We are not liable for failure to provide a booking where this is due to circumstances beyond our reasonable control, including but not limited to natural disasters, bushfires, extreme weather, government restrictions, or public health emergencies. Where such an event affects your stay, we will work with you in good faith on a refund, credit, or rescheduled date.

8. Intellectual Property

Unless otherwise stated, BREATH Hideaways Tasmania and/or its licensors own the intellectual property rights for all material on this website. All rights are reserved. You may access this website for your own personal, non-commercial use, subject to the restrictions in these Terms.

You must not:

• Republish material from this website
• Sell, rent, or sub-license material from this website
• Reproduce, duplicate, or copy material from this website
• Redistribute content from this website

9. Accuracy of Website Content

We aim to keep information on this website accurate and up to date, but we do not guarantee its completeness or accuracy, and we do not promise that the website will always be available or fault-free. Photos are indicative and actual furnishings, decor, or surroundings may vary.

10. Disclaimer and Liability

To the maximum extent permitted by applicable law, we exclude all warranties and conditions relating to this website and your use of it, except where such exclusion is not permitted by law. Nothing in this section limits or excludes:

• our liability for death or personal injury caused by our negligence;
• our liability for fraud or fraudulent misrepresentation; or
• any other liability which cannot be excluded or limited under applicable Australian law (including your rights under the Australian Consumer Law).

Subject to the above, our liability to you in connection with your booking or stay is limited to the amount you paid for that booking.

We may revise these Terms at any time by updating this page. Continued use of our website or a new booking after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Tasmania, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Tasmania.
